Workers’ Compensation Insurance is mandated by state law to provide statutory benefits to employees. Employer’s Liability Insurance provides protection to the employer for claims made against the business by the injured worker and/or his or her family.

States maintaining control of Workers’ Compensation benefits at the state level are known as “Monopolistic States.” Monopolistic states do not include Employer’s Liability coverage with Workers’ Compensation. “Stop Gap” coverage should be purchased by employers in Monopolistic states for protection from employee claims and lawsuits.
